Laws That Affect Your Military Divorce

The federal government has enacted laws to protect military members in several ways in the event of divorce.

These laws include:

  • The Soldiers and Sailors Civil Relief Act (SCRA) governing divorce cases while service members are deployed
  • The Uniformed Services Former Spouses’ Protection Act (USFSPA) governing the calculation and division of military benefits following a divorce

The SCRA prohibits service members from being sued for divorce while on active duty. This law allows divorce proceedings to be postponed while an individual is deployed and for up to 60 days afterward. The service member may waive this right if he or she wishes.

The USFSPA acts as the governing entity that can authorize a portion of a service member’s retirement pay to a former spouse should they divorce. However, federal law requires the marriage to have lasted a minimum of 10 years while the service member was on active duty before authorizing the division and distribution of these retirement benefits.
