Do I Have to Go to Court to Get a Divorce in Orlando?

Not necessarily. Florida offers several options for divorce (also called dissolution of marriage). Divorce is a legal process, and the final order will have to be signed by a judge. However, in some cases, you may have to appear in court just briefly or possibly not at all.

Many parts of the dissolution process may be able to be handled through mediation or other out-of-court processes. If you do have to attend a hearing or court proceeding, your attorney will make sure you know what to expect and help prepare you for any testimony.

Can I File a No-Fault Divorce in Florida?

Yes. A dissolution of marriage in Florida does not require that either spouse prove that the other did anything wrong.

Grounds for divorce in Florida include:

  • The marriage is irretrievably broken; or
  • One spouse has been mentally incapacitated for at least three years.

This doesnโ€™t mean that the court wonโ€™t consider any reasons for the separation when making other decisions related to the divorce, such as spousal support, child support, or custody.

Is Alimony Guaranteed in Orlando?

No. The court will first consider whether one spouse needs alimony (also called spousal support) and, if so, whether the other spouse is capable of paying alimony.

If alimony is needed, Florida family law requires courts to consider numerous factors to determine the amount and conditions of alimony payments.

Some factors include:

  • The standard of living during the marriage
  • Earning capacity of each party
  • The physical and emotional health of each party
  • Parental responsibilities
  • Tax implications of any award
  • Duration of the marriage

Whether you receive spousal support or are ordered to pay it, you want to make sure the arrangement is fair to you. And, alimony can be modified if financial circumstances change.

How Long Does it Take to Get a Divorce in Orlando, Florida?

Every case is different. Simple, uncontested divorces may take several weeks. There are any number of things that can make the process last several months, if not longer. The process involved with valuing and dividing marital property, for example, can be time-consuming.

If the divorce is strongly contested, you may face delay tactics from your spouse or drawn-out court proceedings.

Be prepared to go the distance to get the resolution that you want. Your future is at stake, so you donโ€™t want to compromise just to get it over with. A reputable divorce lawyer will fight for your interests while doing their best to keep the process moving as quickly as possible.
