How Do I Seek A Divorce in Orlando? 

If you are considering a divorce in Orlando, it’s hard to know where to start. Luckily, Florida is a no-fault divorce state. This means you only need to state that you and your spouse have irreconcilable differences when you file your petition for dissolution of marriage.

Your petition must include certain information about your marriage and spouse, as well as any minor children of the marriage, if applicable. Once your petition has been filed, your spouse will have 20 days to respond. If they do not respond within that time frame, you may be able to proceed with an uncontested divorce.  

If they do respond, however, you will then enter into the discovery phase, during which each party can request information from the other. This is often done through formal requests known as interrogatories and requests for the production of documents. 

After discovery has been completed, each side will have an opportunity to negotiate a settlement before going to trial. However, even if you cannot reach an agreement during settlement negotiations, don’t worry—most cases do settle out of court without ever going to trial. In fact, according to Florida law, every couple must attend mediation before their case can be set for trial. Once mediation has occurred (or if mediation is unsuccessful), your case will go before a judge. 

How Will My Property Be Divided in a Divorce in Florida?

In Florida, all property that has been acquired during the marriage is subject to equitable distribution. This means that the court will divide your assets in a way it deems fair but not necessarily equal.

Factors that the court will consider when making its determination include: 

  • The contribution of each spouse to the acquisition of the property, including the contribution of each spouse as a homemaker;
  • The length of the marriage 
  • The age and health of each spouse; 
  • The need for each spouse to have a home or other place to live; 
  • Whether either spouse has custody of a child from another marriage or relationship; and 
  • Any other factor that the court deems relevant. 

It’s important to note that not all assets will be subject to equitable distribution. Any assets that were acquired by one spouse before the marriage or that were inherited by one spouse during the marriage are separate property and may not be subject to distribution.

If you and your spouse are unable to come to an agreement on custody, the court will make a determination based on what it believes is in the best interests of the child. In making this determination, the court will consider factors such as:
